  9. Subscriber Decisions and Responsibility

    RE Software provides software and technology that enables Subscribers to manage auctions, bidder registrations, offers and related transaction processes.

    RE Software does not make the ultimate decision as to whether an individual is permitted to participate in an auction, submit an offer or otherwise participate in a transaction managed by a Subscriber.

    Where a registration, identity verification result, offer, supporting document or other information is submitted through Auctions Live or Offers Live, the relevant Subscriber and its authorised personnel are responsible for reviewing that information and making decisions concerning eligibility, approval, acceptance, participation or any other transaction-related outcome.

    These decisions are made by authorised personnel acting for the relevant Subscriber.

    RE Software provides the technology through which information may be collected, processed, displayed, communicated and recorded but does not replace the Subscriber's responsibility for decisions made in relation to its auction, offer or transaction process.

    Subscribers may also have their own privacy obligations and privacy policies governing how they collect, use and disclose personal information.

  10. Automated Processes and Automated Decision-Making

    Our Platforms use software automation to perform functions necessary to provide our services efficiently and securely.

    These functions may include:

    1. Validating information entered into the Platforms.
    2. Processing registration information.
    3. Processing bidding and offer activity.
    4. Generating system messages and notifications.
    5. Maintaining system records and activity logs.
    6. Supporting security and fraud-prevention functions.
    7. Facilitating integrations and data transfers.
    8. Supporting identity verification workflows.
    9. Receiving and displaying verification results from third-party service providers.
    10. Performing other administrative or technical functions associated with providing our Platforms.

    Third-party identity verification services may use automated processes to perform one or more of the following functions: comparing, validating or assessing information provided during an identity verification process and may return a result, status or other information.

    That information may then be presented through our Platforms to the relevant Subscriber.

    RE Software does not use artificial intelligence or automated systems to make the ultimate decision as to whether an individual may participate in an auction, submit an offer or otherwise participate in a transaction managed by a Subscriber.

    The relevant Subscriber and its authorised personnel remain responsible for reviewing information and making those decisions.

    Automated processes associated with significant decisions

    To the extent required by Australian Privacy Principle 1:

    Kinds of personal information that may be used by automated processes include:

    1. name;
    2. date of birth;
    3. address and contact details;
    4. registration information;
    5. government-issued identification information;
    6. identity verification information;
    7. images or biometric information where an identity verification process requires it;
    8. verification results;
    9. bidding or offer information;
    10. device information;
    11. IP address;
    12. security and technical information; and
    13. other information relevant to the particular process.
    Decisions made solely by automated systems

    As at the date of this Privacy Policy, RE Software does not arrange for Auctions Live, Offers Live or both to make a decision solely by automated means that determines whether an individual is ultimately approved or permitted to participate in an auction, submit an offer or participate in a transaction managed by a Subscriber.

    Automated processes related to decisions made by Subscribers

    Automated systems may perform functions substantially and directly related to a decision ultimately made by a Subscriber's authorised personnel.

    For example, an identity verification service may automatically assess information provided by an individual and return a verification result. That result may be displayed to authorised personnel of the Subscriber and considered by them as part of their review.

    The automated result itself does not constitute the final decision by RE Software as to whether the individual may participate.

    If our use of automated processes changes in a way that affects the disclosures required by Privacy Laws, we will update this Privacy Policy accordingly.

    For information relating to individuals in New Zealand, overseas disclosures will be managed consistently with the requirements of the Privacy Act 2020, including Information Privacy Principle 12 where applicable.
